Trade-up and Recycle up to $400 VISA® prepaid card offer (the “Promotion”)
Subject to these terms and conditions (“Terms and Conditions”), you may be eligible to receive a $100, $150, $200, $300 or $400 Visa® prepaid card when you trade-in your qualifying old netbook, iPad or notebook PC (“Qualifying Trade-in Device”) after purchasing a new qualifying computer (i.e., any Windows 8 touch screen computer) in a Staples store or at Staples.com between 03/03/13 and 27/04/13 (“Qualifying Purchase”). A list of qualifying computers for purchase can be found at the Website.
Opia Limited (“Recycler”) is carrying out this Promotion. These Terms and Conditions of the Promotion can be found on www.Tradeuptotouch.com (the “Website”). By participating in this Promotion, you agree to the Terms and Conditions set forth herein.
- This Promotion is valid on new purchases of qualifying computers made during the promotional period: March 3rd, 2013 through April 27, 2013. Purchases of such qualifying computers must be completed: (i) during store business hours at a Staples store; or (ii) beginning at 12:00:00am ET on the first day of each promotional period and ending at 11:59:59pm ET on the last day of the promotional period at Staples.com, in each case, according to the applicable receipt of purchase.
- To submit a claim, you must visit the Website, click on the “Trade up now” link, and enter the requested information within fourteen (14) calendar days after purchase of your qualifying computer. Provided you pre-qualify according to the Website (as determined by Recycler), you will receive a prepaid shipping label via email. Delete your personal data, then carefully and securely package your netbook or notebook and drop it off at the carrier’s depot or drop box or contact the carrier to arrange pickup. Qualifying trade-in devices must be received by the Recycler within thirty (30) calendar days after the date of purchase of a qualifying new netbook or notebook. Any trade-in device not received within thirty (30) days after the date of purchase of a qualifying computer will be deemed invalid.
- The promotion is open to residents of the United States of America only and void where prohibited. This offer is not open to employees of Staples the Office Superstore, LLC or its parent, subsidiaries, divisions, affiliates (collectively, “Staples”) or their respective employees, agents, staff or anyone connected with the Promotion.
- To qualify for the Promotion, you must send in your Qualifying Trade-in Device accompanied by a copy of your completed claim form (available at the Website) and a copy of your purchase invoice or receipt clearly detailing the purchase of your qualifying new computer dated within the promotional periods. No other proof of purchase is acceptable. Please do not send the original receipt, as your proof of purchase will not be sent back to you.
For your trade in device to qualify for the full amount, it must be fully operational, include the main battery and power supply, must not be permanently marked or defaced, it must be complete and undamaged (reasonable wear & tear accepted) and be one of the following models:

- Trade-in devices should be sent to Tradeuptotouch, 8801 Washington Blvd., Suite 101, Roseville, California 95678 using the prepaid shipping label provided or dropped off at your local UPS Store.
- Claims must be submitted by the owner of the qualifying trade-in device and the purchaser of the new qualifying netbook or notebook only.
- The Recycler reserves the right to monitor usage of the Website, including users IP addresses, so that it may identify misuse, fraud or disqualify claims if it has reason to believe (in Recycler’s sole discretion) these Terms and Conditions have not been followed or have been breached.
- This Promotion is only open and applicable to the purchase of specific qualifying netbooks and notebooks listed at www.tradeuptotouch.com and evidenced by an original purchase invoice or receipt.
- If Recycler determines that a traded in device does not qualify as set forth in these Terms and Conditions, Recycler will return or dispose of the traded in device or provide a prepaid card at a lesser value.
- The Promotion is limited to only five prepaid cards per customer, but only one prepaid card per device.
- Customer represents and warrants that they have wiped all proprietary or confidential data and information (including, but not limited to, personally identifiable information, credit card details or other sensitive data) from the trade-in device. Customer acknowledges and agrees that it is solely and exclusively responsible to delete all data and information from the trade-in device (including, but not limited to, the hard drive and any other storage media in the product and remove any removable storage media such as DVD’s, CDs or SD cards). Instructions on how to wipe your data or information can be found here. Neither Staples, the Recycler, the courier or any of their respective employees, officers, directors, affiliates, agents or representatives shall be responsible for the loss, unauthorized disclosure, theft, or compromise of any data or information on your trade-in device (including any personally identifiable information or other highly sensitive data). Without limiting any of the foregoing, solely as a courtesy and without obligation to customer, Recycler will delete the data and information on each traded-in device in accordance with its procedures detailed on the Website, as may be changed or updated by Recycler with no notice to customer. Recycler shall not be required to retrieve any data or information from a trade-in device. If upon arrival your computer hard drive cannot be wiped, it will be destroyed to protect your privacy, this will not affect your reward.
- Return of a Qualifying Purchase to the seller following submission of the claim via www.tradeuptotouch.com will disentitle the participant to the trade in reward.
- Recycler is not responsible, and will not accept liability, for any claims that are misdirected, late, lost, stolen, illegible, incomplete, damaged or destroyed.
- Provided that the Terms and Conditions of this Promotion have been met, your prepaid card will be sent within twenty one (21) business days of validation of your claim. Please allow up to ten (10) additional business days to allow for postage delays.
- Your prepaid card must be activated directly with the card supplier using a 4 digit PIN. The card is valid for 12 calendar months from the date of issue stated on the card.
- Neither Staples nor Recycler is responsible or liable for any loss of data, technical, hardware, software, server, website, or other failures or damage of any kind to the extent such loss, failure or damage prevents the participant from or otherwise obstructs him/her in participating in the Promotion.

These Terms and Conditions and the Promotion shall be construed in accordance with the laws of the State of Delaware, except for any conflict or choice-of-law principle thereof that would lead to the application of another jurisdiction’s laws to the rights and duties of the parties. By using the Website or participating in the Promotion, you agree to submit any and all disputes to the exclusive jurisdiction of the state or federal courts located in the State of Delaware, or, at Recycler’s sole election, to binding arbitration before a single arbitrator pursuant to the American Arbitration Association’s Commercial Dispute Resolution Procedures, with such arbitration to take place in a location determined by Recycler.
- UNDER NO CIRCUMSTANCES SHALL STAPLES OR RECYCLER OR ANY OF ITS AFFILIATES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DIRECT, SPECIAL, EXEMPLARY, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, COSTS OR ATTORNEY’S FEES ARISING OUT OF OR RELATING TO THE PROMOTION, THIS WEBSITE OR THE PREPAID CARD. RECYCLER’S SOLE AND EXCLUSIVE TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF THE VALUE OF YOUR TRADED-IN DEVICE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
If any of the criteria are not wholly fulfilled or are missing from the package received by Recycler or if the traded in device does not otherwise qualify for the Promotion, you may receive a revised valuation as determined by Recycler by email, conditions considered beyond fair wear and tear are as follows:
If the lesser value of the prepaid card is not acceptable to you, you may request return of your traded in device. If Recycler does not receive a reply within ten (10) days after the date of the email, the value of the prepaid card will be deemed accepted by you.
